Access to and use of this Website, as well as the purchase of products, imply full acceptance of these Terms and Conditions of Sale (the “Terms”).

These Terms govern the online sale of products bearing the MISUTERI brand through the Website, in accordance with Italian law (Legislative Decree 70/2003) and the EU Consumer Code (Legislative Decree 206/2005).

All MISUTERI products are crafted in limited quantities and may be available only for specific periods (“capsules” or “limited editions”).

MISUTERI reserves the right to modify the assortment, prices, or product availability prior to order confirmation, without prior notice. Once an order is confirmed, the details (price, product, and availability) are binding and cannot be changed unilaterally.

Images and descriptions shown on the Website are for illustrative purposes and may slightly differ from the final product due to artisanal variations or photographic rendering.

All prices displayed on the Website are shown in the local currency of the destination country selected by the user.

For orders shipped within the European Union, prices include VAT, where applicable, in accordance with the relevant regulations.

For orders shipped outside the European Union, prices are inclusive of all applicable customs duties, import taxes, and local charges — no additional fees will be applied upon delivery or at customs.

Shipping costs are not included in the product prices and will be calculated and shown separately during the checkout process, before the order is finalized.

All transactions are processed securely using encrypted protocols.

An order is confirmed only after full payment has been received.

MISUTERI ships worldwide.

Shipping costs:

• For orders shipped within the European Union (27 member countries), shipping is free for orders over €200 (calculated on the value of the products, excluding shipping costs).

• For orders shipped outside the European Union, shipping is free for orders over €500 (calculated on the value of the products, excluding shipping costs).

• For orders below these thresholds, shipping costs are automatically calculated at checkout.

Delivery times:

• 2–5 business days for shipments within Italy and the European Union.

• 5–10 business days for destinations outside the EU.

In any case, delivery will occur within a maximum of 30 days from order confirmation. If this timeframe cannot be met, the customer has the right to withdraw from the purchase.

Duties, taxes, and additional charges:

For shipments outside the European Union, all applicable customs duties, import taxes, and local charges are included in the price displayed at checkout — no additional fees.

Limitation of liability:

MISUTERI shall not be liable for any delivery delays caused by customs clearance, force majeure, or events beyond its control.

Pursuant to Directive 2011/83/EU and Italian Legislative Decree No. 206/2005 (Consumer Code), consumers residing within the European Union have the right to withdraw from the purchase contract within 14 (fourteen) days from the date of delivery of the product, without any obligation to provide reasons. Where a single order consists of multiple products delivered separately, the withdrawal period shall commence on the date of delivery of the last item.

How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the customer must communicate their decision by means of an explicit and unequivocal statement, sent by email to support@misuterimilano.com within 14 (fourteen) days from the date of delivery, indicating the order number and the items subject to the withdrawal.

The customer may, but is not required to, use the model withdrawal form provided below.

The burden of proving the proper exercise of the right of withdrawal rests with the customer. The communication shall be deemed to have been validly submitted if it is sent no later than the fourteenth day.

After withdrawing, the customer must return the goods without undue delay and in any event within 14 (fourteen) days of communicating the withdrawal. The deadline is met if the goods are handed to the carrier before it expires. The direct cost of returning the goods is borne by thecustomer, as disclosed prior to completing the purchase.

The goods travel under the customer’s responsibility until received at our warehouse. We strongly recommend a tracked and insured shipping method: in the event of loss or damage during the return transit, the customer must provide proof of dispatch.

The customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning, as would be permitted in a physical store (Art. 57(2), Legislative Decree 206/2005).
Accordingly, items must be returned:
• not worn beyond a simple try-on, not washed and not altered;
• free from odours, stains, wear creases, make-up or fragrance marks;
• with all original tags and labels still attached;
• in the original undamaged packaging, including box, protective bags and any accessories provided.

Where a returned item shows signs of use beyond the permitted try-on, tampering, damage, removed tags, or missing or deteriorated packaging, MISUTERI will apply a corresponding reduction to the refunded amount, proportionate to the loss of value. As our items are produced in limited quantities and are not restocked, where the condition of the goods prevents their resale as new the reduction may amount to the full value of the product. The assessment is carried out by MISUTERI upon inspection of the return; the customer will be informed of any reduction applied.

The refund will be issued without undue delay and in any event within 14 (fourteen) days of the date we are informed of the withdrawal.

As a matter of ordinary practice, the refund is processed after the returned goods have reached our warehouse and have been inspected, in order to determine any reduction in value under point “Condition of the goods and reduction of the refund”.

MISUTERI may withhold the refund until it has received the returned goods, or until the customer has supplied proof of having sent themback, whichever is the earlier.

The refund covers the price of the goods and the standard delivery costs paid at the time of the order; supplementary costs arising from the customer’s choice of a delivery method other than the least expensive standard option offered are not refundable. The refund is made using the same payment method used for the purchase, unless otherwise agreed, at no cost to the customer.

Pursuant to Art. 59, Legislative Decree 206/2005, the right of withdrawal does not apply to: goods made to measure or clearly personalised to the customer’s specifications (including items produced to individual order, e.g. MANIFESTO where produced on the customer’s request);

sealed goods which are not suitable for return for reasons of hygiene or health protection, where they have been unsealed after delivery.

For hygiene reasons, items intended for piercing or direct skin contact (such as earrings) that are sold in sealed packaging are not eligible for return once the seal has been broken after delivery, in accordance with Art. 59 of Legislative Decree 206/2005.

This exclusion does not apply to jewellery items not sold in sealed packaging, such as rings, which remain subject to the standard right of withdrawal. These exclusions apply only in the cases provided for by law. All other items — including limited editions and non-personalised limited-stock pieces — remain subject to the right of withdrawal under the conditions set out above.

We do not offer size exchanges. If you require a different size, you may withdraw from the eligible item, obtain a refund and place a new order, subject to availability

Returns are handled on a case-by-case basis.

• Customers must contact support@misuterimilano.com within 14 daysof delivery to request authorization and provide photos of the item.

• All return shipping costs, as well as original shipping fees, are the customer's responsibility and are non-refundable.

• Items must comply with the same return conditions as EU orders (perfect condition, original packaging, no scratches or marks caused by the customer, all tags attached).

Once the returned item is received and inspected, MISUTERI will process a refund within 7–10 business days using the same payment method used for the original purchase.

Important:

• Refunds include the product price only.

• Premium shipping and original shipping fees are never refundable.

• Returns that do not comply with the return conditions outlined above will not be refunded.

If a product arrives damaged or defective, the customer must contact support@misuterimilano.com within 48 hours of delivery, providing detailed photos of the issue.

After verification, MISUTERI may offer:

• a replacement, if available; or

• a full refund, including shipping costs.

Independently of the right of withdrawal, EU consumers benefit fromthe 24 (twenty- four) month legal guarantee of conformity provided by applicable law for goods that are defective or not in conformity with the contract. This guarantee is not subject to any short notification deadline and remains unaffected by any other provision of this policy.

Minor imperfections, slight colour variations or natural characteristics resulting from the artisanal Made-in-Italy production process are inherent to manufacturing and do not constitute defects of conformity or grounds for return.



Defective, damaged or incorrect items on delivery

If, upon delivery, the product is damaged in transit, defective, ordifferent from the one ordered, we invite you — as an operational courtesy, to allow us to handle the matter promptly — to contact support@misuterimilano.com within 48 hours of delivery, providing detailed photographs of the item and its packaging.

Once the claim has been reviewed, MISUTERI will, where applicable, either replace the item if available or issue a full refund, including the original shipping costs.

Failure to report within 48 hours does not in any way affect the consumer’s rights under the 24-month legal guarantee of conformity.

Non-EU customers (including the USA)

Orders shipped outside the European Union are final sale and are not eligible for returns or exchanges, except where the item is defective or an incorrect product has been delivered. In such cases the procedure under the previous point applies.

• indirect, consequential, or incidental damages arising from the use of the Website or products;

• delivery delays due to force majeure or external causes;

• typographical or technical errors appearing on the Website.

Any unauthorized reproduction, distribution, or use is strictly prohibited.
